Beacon Statement on Tort Reform Ruling
Yesterday, the Tennessee Supreme Court set aside a lower court’s ruling that struck down our state’s important tort reform laws. The Court ruled that it was premature for the trial judge to say that caps on noneconomic damages were unconstitutional in that case, given that no jury had awarded damages in excess of the caps.
Beacon CEO Justin Owen had this to say about the ruling: “The Beacon Center applauds the Supreme Court’s decision to set aside the lower court’s ruling, and we look forward to the day when our state Supreme Court rules once and for all that Tennessee’s litigation reforms are good for our economy. While trial lawyers will continue to use flawed and misleading arguments to strike down these important reforms, we believe that the Tennessee Civil Justice Act will withstand these challenges and continue to provide stability in our justice system for decades to come.”
